These Terms and Conditions ("Terms") govern your access to and use of FarmTableDirect (the "Platform"), operated by FarmTableDirect LLC, an Idaho limited liability company ("Company," "we," "us," or "our"). By creating an account or otherwise accessing or using the Platform, you agree to be bound by these Terms.
FarmTableDirect is a directory service platform that facilitates connections between local farmers and ranchers and consumers. The Platform enables users to locate and communicate with one another. The Company is not a party to any sale, purchase, or other agreement between a farmer or rancher and a buyer. The Company does not process payments. All matters relating to payment, delivery, pickup, orders, and related arrangements occur solely between the farmer or rancher and the buyer, outside the Platform.
Farmers and ranchers are solely responsible for the descriptions of their products and practices appearing on their storefronts, including without limitation claims such as "grass-fed," "pasture-raised," "non-GMO," organic status, or any other representations. The Company does not independently verify, inspect, certify, or guarantee any such claims. Users are solely responsible for verifying any claim that is material to them and are encouraged to inquire directly with the applicable farmer or rancher prior to any purchase. Farmers and producers are expected to provide accurate, transparent, and honest information.
All purchases are made directly from independent farmers or ranchers and not from the Company. The Company assumes no responsibility for the quality, safety, legality, labeling, or handling of any product sold as a result of a connection made through the Platform, nor for any disputes, damages, illness, injury, or losses arising from any transaction between a farmer or rancher and a buyer. Consumers and farmers or ranchers are each solely responsible for compliance with all applicable food safety, licensing, and related laws governing their respective transactions. Users engage with other users and farms at their own risk and are solely responsible for conducting appropriate due diligence.
You retain ownership of all photographs, descriptions, and other content you submit to the Platform. By posting such content, you grant the Company a non-exclusive, royalty-free license to display and use such content solely in connection with the operation of the Platform. The Company does not claim ownership of your content.
You may not post any lewd, suggestive, pornographic, or otherwise inappropriate content. Foul language and cursing are prohibited. The Platform is intended to be family-friendly. Violation of these content standards may result in immediate suspension.
You agree not to use the Platform to defraud any person, engage in illegal activity, sell illegal products, harass any user, misrepresent your identity or the products or services you offer, or interfere in any manner with the normal operation of the Platform.
The Platform is provided on an "as is" and "as available" basis. The Company makes no warranties or representations regarding uninterrupted, error-free, or continuous availability of the Platform. The Platform is actively developed, and features or functionality may change from time to time as improvements are implemented.
To the maximum extent permitted by applicable law, FarmTableDirect LLC, its owners, and its representatives shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Platform or any transaction entered into with another user.
The Company may modify these Terms at any time. Updated Terms will be posted on the Platform. Your continued use of the Platform following the posting of any modifications constitutes your acceptance of the revised Terms. You are encouraged to review these Terms periodically.
These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law principles.
